Article 1 – Identity of the Entrepreneur

Article 2 – Applicability & Target Group
- These general terms and conditions apply to all offers, orders and agreements concluded via the webshop and outside the webshop.
- A distinction is made between:
- Consumer (B2C): a natural person acting outside the exercise of a profession or business
- Business customer (B2B): any natural or legal person acting in the exercise of a profession or business
- Deviations from these terms and conditions are only valid if agreed in writing.
- If any provision is found to be invalid, the remaining provisions shall remain fully in force.
Article 3 – Definitions
In these terms and conditions, the following definitions apply:
- Webshop: the online store of Dunja Toys B.V.
- Customer: a consumer or business customer
- Product: all goods offered via the webshop
- Agreement: any agreement concluded between the entrepreneur and the customer regarding the supply of products, regardless of whether such agreement is concluded via the webshop, in writing, by email, or through any other (online or offline) sales channel.
Article 4 – Offers & Product Information
- All offers are non-binding and valid while stocks last.
- Product descriptions and images are provided as accurately as possible but are for illustrative purposes only.
- Obvious errors or mistakes do not bind the webshop.
- The assortment may be changed without prior notice.
Article 5 – Conclusion of the Agreement
- The agreement is concluded once the customer has completed the ordering process and payment has been successfully completed.
- After placing an order, the customer will receive an order confirmation by email.
- The webshop reserves the right to refuse orders for justified reasons (e.g. payment risks).
Article 6 – Prices & Payment
- All prices are:
- B2C: inclusive of VAT
- B2B: exclusive of VAT, unless stated otherwise
- Shipping costs are stated separately.
- Payment must be made in advance using the available payment methods, unless otherwise agreed in writing.
- In the event of late payment by business customers, statutory commercial interest and collection costs may be charged.
Article 7 – Delivery & Risk
- Delivery takes place at the address provided by the customer.
- Delivery times are indicative and never binding deadlines.
- The risk of damage or loss passes to:
- B2C: upon delivery to the consumer
- B2B: upon dispatch
- If delivery proves impossible, the customer will be informed in a timely manner.
Article 8 – Right of Withdrawal (B2C only)
- Consumers have the right to withdraw from the agreement within 14 days without stating any reason.
- The withdrawal period starts on the day the product is received.
- The product must be returned unused and, if reasonably possible, in its original packaging.
- Return shipping costs are borne by the consumer.
- Business customers do not have a right of withdrawal, unless otherwise agreed.
Article 9 – Returns (B2B)
- Returns by business customers are only accepted after prior written approval.
- Any costs associated with returns are borne by the business customer.
- Customized or specially ordered products cannot be returned.
Article 10 – Warranty & Conformity
For consumers (B2C)
- Products must comply with the agreement and applicable legal requirements.
- Defects must be reported as soon as possible.
- In the event of a valid complaint, repair, replacement or refund will be provided.
For business customers (B2B)
- Warranty is limited to manufacturing defects only.
- Complaints must be reported within 7 days of delivery.
- Liability is limited to replacement or crediting of the product.
Article 11 – Use of the Website
- The customer shall use the website carefully and lawfully.

It is prohibited to bypass security measures or disrupt the operation of the website.
Article 12 – Liability
- The webshop is not liable for indirect or consequential damage.
- Liability is limited to the invoice amount of the relevant product.
- Damage resulting from improper or incorrect use falls outside liability.
Article 13 – Force Majeure
- In cases of force majeure, the webshop is not obliged to fulfil its obligations.
- The customer will be informed as soon as possible.
- Force majeure includes, but is not limited to, disruptions, transport problems, government measures, natural disasters and strikes.
Article 14 – Privacy & Personal Data
- Personal data is processed in accordance with the GDPR.

Article 15 – Intellectual Property
- All intellectual property rights belong to the webshop or its licensors.
- Use without prior permission is not permitted.
Article 16 – Complaints & Customer Service
- Questions or complaints can be submitted via email or telephone.

Complaints will be answered within 14 days.
Article 17 – Applicable Law & Disputes
- These terms and conditions are exclusively governed by Dutch law.
- Disputes will be submitted to the competent court in the district where the webshop is established.
